Postalytics MailBackTM Agreement

  1. General Terms
    • The terms of this Postalytics MailBackTM Agreement (this “PMBA”) apply to your (“you”, “your”, “Customer”) use of the Postalytics MailBackTM In the event of a conflict between the terms of this PMBA and the terms of your Service Agreement with Postalytics, Inc. (“Postalytics”), the terms and conditions of this PMBA will apply with respect to your use of the Postalytics MailBackTM Services, but only to the extent of such conflict.
    • You agree that your use of Postalytics services is subject both to the terms and conditions of this PMBA, and the terms and conditions governing the use of such Postalytics services, including your Service Agreement with Postalytics.
    • You, as the installer of tracking pixels required for using Postalytics MailBackTM Services, have certain responsibilities to comply with the California Consumer Privacy Act (CCPA), the California Invasion of Privacy Act (CIPA), and other consumer personally identifiable information (“PII”) regulations.
    • Postalytics may modify this PMBA at any time by posting a revised version on our site or by otherwise notifying you as provided in the Service Agreement, and that your continued use of the Postalytics MailBackTM Services following such modification will constitute acceptance of such modifications.
  2. Indemnification
    • Customer agrees to protect, defend, indemnify and hold harmless Postalytics and its officers, directors, employees, agents, and third party service providers from and against any and all claims, demands, costs, expenses, losses, liabilities and damages of every kind and nature (including, without limitation, reasonable attorneys’ fees) imposed upon or incurred by Postalytics directly or indirectly arising from (i) Customer’s and/or its End User’s use of and access to the Services; (ii) Customer’s violation of any provision of the Service Agreement, this PMBA or the policies or agreements which are incorporated herein; (iii) Customer’s non-compliance with any applicable data protection law or regulation; and/or (iv) Customer’s violation of any third-party right, including without limitation any intellectual property, privacy, or other proprietary right. The indemnification obligations under this section shall survive any termination or expiration of this PMBA.
